At English Turn, New Orleans, the Chairman of the Board is Val Exnicious, a plaintiff attorney, who is partner of Bobby Nungesser, a Parish President. Val has been KING for 9 long years, less than 2 years after moving to ET...and the level of sucking up, the number of simpering courtiers, the abject submission of most of the clientele reminds one of France before the Revolution. Anyone who treads up against King Val - well, he took us to court requesting 220K in fines, predominately for using the equipment required to restore our own home after massive damage by H. Katrina - charging us with 'storing equipment' because heavy equipment needed to be used to replace the roof, chimney, balconies...with 'operating a business out of our home' - because my husband's own construction related company did the work...36K in fines for 'having signs in yard' - yet we never had a SINGLE sign, in court they changed that to accusing his company of having signs in others people's yards for shingle deliveries because his company had to roof over 100 houses (and he's a commercial contractor, only hired and managed some roofing crews because everyone desperately needed roofs - and never had or allowed any signs advertising that either, another lie)....after 50K in legal fees all of these unsubstantiated accusations, without one shred of evidence, were rightfully thrown out.
Yet the Judge awarded the HOA 180K when they changed up and claimed that the standard brick flower border, identical to dozens of others back in ET, and an invisible small therapeutic jacuzzi in a nook formed by our house that they had to provide aerial photos of - were entitled to $100 a day fines until PAID. Even though we'd moved (fled from nonstop harrassment!!!) from ET and taken the jacuzzi with us over 3 YEARS PRIOR TO GOING TO COURT! It hadn't been there for over 3 years yet they can still claim $100 a day?!
Of course we appealed, in the works, another $25K in legal fees, oral arguments in August scheduled.
BUT OH MY GOD. I'm a physician and I've seen some batsh*t crazy stuff. But I have never seen, and hope I never see, the level of insanity, greed and corruption, targeting and trying to destroy families that is the Modern HOA. My husband and I have fought, wept and almost divorced over the constant stress for over 6 years now. Not only can it be financially devastating but try to have a happy family, marraige and raise your kids while under persecution and living in misery. Its very difficult and clouds EVERYTHING about your life, constantly. Literally nauseating and depressing. Its all we can do to keep it all together. And over a hurricane-damaged home, a flower bed border and a completely invisible and private jacuzzi? Where's the justice???
